Terms of Service
01About these terms
These Terms of Service (“Terms”) form a binding agreement between you and MeatDrop (Pty) Ltd(“MeatDrop”, “we”, “us”), a private company incorporated in the Republic of South Africa. By browsing meatdrp.com, registering an account, or placing an order, you agree to these Terms together with the Privacy Policy set out in Part Two.
If you do not agree, please do not use the site. These Terms are written in plain language as required by section 22 of the Consumer Protection Act 68 of 2008(“CPA”). Where the CPA, the Electronic Communications and Transactions Act 25 of 2002(“ECTA”), or the Protection of Personal Information Act 4 of 2013(“POPIA”) confer rights on you that cannot be waived, those rights prevail over anything in these Terms.
Heads-up
Certain clauses below limit our liability, govern returns, and require you to indemnify us in specific circumstances. We've highlighted these where they appear so you can read them carefully.
02Definitions
- Site — meatdrp.com and any associated subdomains, mobile interfaces, and ordering channels.
- Products — fresh, frozen, cured, or prepared meat and related goods listed for sale on the Site.
- Customer — any natural or juristic person who orders Products from us.
- Delivery Address — the physical address in South Africa nominated by you for fulfilment.
- Personal Information — as defined in section 1 of POPIA.
03Your account
To order, you must be at least 18 years old and legally capable of contracting under South African law. You're responsible for keeping your login credentials confidential and for any activity on your account. Notify us immediately at hello@meatdrp.com if you suspect unauthorised use.
You agree to provide accurate, current information. We may suspend or close accounts that contain false information, are used to abuse promotions, or that breach these Terms.
04Orders & pricing
All prices are quoted in South African Rand (ZAR) and include VAT at the prevailing rate unless stated otherwise. Prices, product availability, and cuts are subject to change without notice; the price displayed at the time you complete checkout is the price that applies to your order.
Placing an order is an offer by you to purchase. A binding contract of sale forms only when we send you an order confirmation by email. We reserve the right to decline or cancel an order before dispatch where:
- a Product is out of stock or has been mispriced as a result of an obvious error;
- we cannot verify your billing or delivery details;
- we reasonably suspect fraud or breach of these Terms.
Where your card has been charged for a cancelled order, we will reverse the charge in full to the same payment method within 7 business days.
Weight-based pricing
Some Products are sold by weight and the final price may vary slightly from the indicative price displayed. Any variance greater than 10% will be communicated to you for approval before dispatch.
05Delivery & cold chain
We deliver to addresses within our published service areas. Delivery windows are estimates given in good faith and are not guaranteed. Risk in the Products passes to you on delivery to the Delivery Address or to a person who accepts the parcel on your behalf at that address.
Because Products are perishable, somebody must be available to receive the order during the agreed window. If delivery fails because no one is present, the address is inaccessible, or the Products cannot safely be left, we may charge a re-delivery fee or, if the cold chain has been compromised, treat the order as delivered.
Cold chain
Once Products have been left in your possession or in a place you've nominated (e.g. with a neighbour, security, or in a cooler box at the gate), responsibility for refrigeration passes to you.
06Returns, refunds & the CPA
Your statutory rights under the CPA are not affected by anything below.
Quality and freshness guarantee
Under section 55 of the CPA, you have the right to receive Products that are of good quality, in good working order, and free from defects. If a Product is spoiled, mislabelled, of unacceptable quality, or unsafe on delivery, contact us within 24 hours of delivery with a description and photographs. We will, at your election, replace the Product, refund the purchase price, or issue store credit.
Cooling-off (ECTA section 44)
Section 44 of ECTA gives consumers a 7-day cooling-off right for many electronic transactions. This right does not apply to perishable goods, including fresh and frozen meat, by virtue of section 42(2)(g) of ECTA. Returns are therefore handled under the quality guarantee above rather than as a cooling-off cancellation.
Refund method
Approved refunds are processed to the original payment method within 7 business days of approval. Bank-side clearing times are outside our control.
07Acceptable use
You agree not to use the Site to:
- place orders fraudulently or with stolen payment instruments;
- scrape, mirror, or systematically extract content;
- introduce malware, attempt to bypass security, or interfere with the Site's operation;
- resell our Products commercially without our prior written consent.
08Intellectual property
The MeatDrop name, logo, photography, recipe content, and the Site's overall look and feel are protected by copyright, trade marks, and other intellectual property rights owned by or licensed to us. You may view and share the Site for personal, non-commercial purposes. All other use requires our prior written permission.
09Liability & risk
To the fullest extent permitted by law, and subject always to your rights under the CPA, our aggregate liability arising from or in connection with any order is limited to the amount you paid for that order.
We do not exclude or limit liability for: death or personal injury caused by our gross negligence; fraud; or any liability that cannot lawfully be excluded under the CPA, POPIA, or ECTA.
We are not liable for harm caused by improper handling, storage, or preparation of Products after delivery. Always follow food safety guidance: keep raw meat refrigerated below 4 °C, cook to safe internal temperatures, and avoid cross-contamination.
10Termination
You may close your account at any time by emailing us. We may suspend or terminate your access to the Site if you materially breach these Terms, with reasonable notice unless the breach is serious or repeated. Termination doesn't affect orders already in progress, accrued rights, or clauses that by their nature survive (intellectual property, liability, governing law).
11Disputes & governing law
These Terms are governed by the laws of the Republic of South Africa. Before going to court, please contact us so we can try to resolve the issue directly.
If we can't resolve it, you may approach:
- the Consumer Goods and Services Ombud (cgso.org.za);
- the National Consumer Commission under the CPA;
- the Information Regulator for POPIA-related complaints (inforegulator.org.za);
- the Magistrates' Courts or High Court of South Africa, which have jurisdiction.
Privacy Policy
12Privacy at MeatDrop
MeatDrop is the Responsible Party for your Personal Information under POPIA. We process your information lawfully, transparently, and only for the purposes set out below. This Policy explains what we collect, why, who we share it with, and how you can exercise your rights.
13Information we collect
You give us
- identity details: name, surname, date of birth (where required for age-restricted Products);
- contact details: email, mobile number, delivery and billing address;
- order history, dietary preferences, and any notes you add at checkout;
- communications you send to support, including photographs you submit with quality complaints.
Collected automatically
- device and browser information, IP address, approximate location;
- pages viewed, items added to cart, referral source;
- cookies and similar technologies (see clause 18).
From third parties
- payment confirmations from our payment gateway (we do not store your full card number);
- delivery status updates from our courier partners;
- fraud-screening signals where used.
14How & why we use it
We process Personal Information for the following purposes, each grounded in a lawful basis under section 11 of POPIA:
- To perform the contract: take and fulfil orders, arrange delivery, handle returns, send transactional emails.
- To meet legal obligations: tax, accounting, food safety records, and lawful requests from regulators.
- For our legitimate interests: fraud prevention, securing the Site, analytics on aggregate usage, improving our products and service.
- With your consent: marketing communications, product recommendations, loyalty programmes. You can withdraw consent at any time without affecting earlier processing.
16Retention & security
We keep Personal Information only for as long as necessary for the purposes for which it was collected, or as required by law. Tax and accounting records are kept for at least 5 years as required by SARS. Order data is typically retained for 7 years. Marketing data is retained until you unsubscribe or ask us to delete it.
We use reasonable technical and organisational measures to protect your information, including TLS encryption, access controls, and regular reviews. No system is perfectly secure; if a breach involving your Personal Information occurs, we will notify the Information Regulator and affected data subjects as required by section 22 of POPIA.
17Your POPIA rights
As a data subject you have the right to:
- be told what Personal Information we hold about you and request a copy;
- ask us to correct or delete inaccurate, irrelevant, excessive, or out-of-date information;
- object, on reasonable grounds, to the processing of your Personal Information;
- object to direct marketing and unsubscribe at any time;
- withdraw any consent you have given;
- complain to the Information Regulator.
To exercise any of these rights, email our Information Officer (clause 20). We may need to verify your identity before responding. We aim to respond within 30 days.
19Changes to this page
We may update these Terms or this Privacy Policy from time to time. The “Effective” date at the top of the page reflects the latest version. Where changes materially affect your rights, we will give you reasonable advance notice by email or a Site notice. Continuing to use the Site after the effective date constitutes acceptance of the updated version.
